EU To Probe Samsung Patent Abuse

A formal investigation has been initiated against Samsung by the European Commission to see whether the latter has used all their patents to distort the competition to capture the mobile market in entire Europe.

By using their patent use theory, Samsung tried their level best to ban all Apple products in the various European Union member states which include Germany, France, Italy and Holland. But the efforts have not yet been successful and Apple products continued to be quite popular in those states.

The European Commission will try to investigate whether Samsung has been able to honor their commitment of 1998 given to the European Telecommunications Standards Institute (ETSI) where they have stated that they have agreed to “to license any standard essential patents relating to European mobile telephony standards on fair, reasonable and non-discriminatory (FRAND) terms.”

The Commission will try to find out whether by doing such activities, Samsung has abused the dominant position which cannot be done under the Article 102 of the Treaty on the functioning of EU.
